TERMS AND CONDITIONS
GENERAL
Insider Divers is offered by BVI registered Insider Divers Ltd. and we look forward to act as your booking agent for your travel needs. These terms and conditions (the "Agreement") describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer. The terms "we", "us" and "our" refer to Insider Divers. The term "you" refers to the customer, booking a reservation through us or otherwise using our services.
We sell a variety of ocean activity trips from different suppliers and service providers ("Suppliers"). Each Supplier has its own terms and condition that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Our website, which is referred throughout this Agreement, can be found at www.insiderdivers.com.
Insider Divers is acting as intermediary or a "Booking Agent" for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not co-vendors of such products and services. We add services to the service product (e.g. professional guide and photographer, extra excursions, presentations, merchandise etc.)
All products are subject to supplemental price increases that may apply post-purchase. These price increases can be due to additional costs levied by a Supplier or government or through exchange rate fluctuations. You, by accepting these terms, consent to any post-purchase price increases and authorize Insider Divers Ltd. to charge the additional amounts.
LIABILITY
Insider Divers Ltd. takes no responsibility for loss, damage, or injury arising from any shortfall, error, or omission in the information passed to the customer during the course of the sale or subsequent delivery of the product. The company also takes no responsibility nor can it be held liable for loss, damage, or injury that occurs on a Supplier’s or service provider’s premises or transport, or between two such premises.
Professional LIABILITY
Participation in any of the Activities involves certain risks which may result in injury or death. This warning does not purport to describe or disclose all risks associated with participation of the Activities. There are a wide range of inherent risks when engaging in sports and particularly underwater sports; for example, with diving there is the risk of decompression sickness, embolism or other hyperbaric injury can occur that requires treatment in a recompression chamber. Open water scuba diving trips may be conducted at sites that are remote, either by time or distance, from emergency services or recompression facilities. Scuba diving, snorkeling and tours will involve uncontrolled encounters with wild animals which bears the risk of stings, bites, and at the extreme end, more serious injury and death. Participants should be responsible and aware of animal behaviors and their own interactions and engage in these activities entirely at their own risk.
We will not be liable to you in respect of any personal injury (including without limitation serious injury or death) that you may suffer or sustain directly or indirectly as a result of attending the Trip or participation in the Activities. Nor will we be liable to you in respect of any other losses arising as a result of any such personal injury (including without limitation loss of profit or earnings or other consequential losses). We will not be liable to you in respect of any of your personal property that is lost, stolen or damaged before, during or after a Trip.
DEPOSIT AND PAYMENT
Deposits and full payments are generally non-refundable unless we find a full replacement for your booking.
The idea of a deposit is a commitment from your side towards the trip. We need to pay the operators (boats, hotels, dive shops) in advance, so we require some security that you plan to come. If you need to cancel we will search a replacement for you, unless you cancel last minute we mostly can find a replacement for you. When a replacement is found your monies will convert into travel credit with Insider Divers minus a cancellation fee of USD300. If we need to discount your spot to find a replacement this discount will reduce your travel credit accordingly.
This is also the case for all personal and medically caused cancellations. We will provide you with documentation for your travel insurance, please make sure to take out travel insurance. Please read the section below about cancellation procedures.
We will advise you of the date that full payment is required. Upon your provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding operator and their cancellation policies apply.
If we book flights in your name a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier.
In rare cases after full payment the conditions of the contract with our Supplier may permit them to increase the cost of your arrangements - examples are increase in fuel costs, currency exchanges, marine park fees etc. We are required to pass on any such increase to you.
OPERATOR CANCELLATIONS
In the case that the local operator of your trip cancels activity days we will do our best to secure funds from the operator. In cases of cancellations due to travel restrictions, governmental regulation, weather incidents or force majeure we will negotiate with the operator in the clients name and aim to provide the best possible compensation. We cannot guarantee that monies can be returned to the client, as we are dependent on what our local operator offers. Insider Divers will not refund lost activity days unless funds are recovered from the local operator.
We are working closely with all our operators and aim to achieve 100% rebooking value on all cancelled/postponed trips. We are focused on securing the best possible deal for our clients including securing replacement trips. However that is not guaranteed and depends on what the operator can provide.
ACCOMODATIONS
Based on shared occupancy. A single supplement is usually charged where one person necessitates single occupancy in accommodation, irrespective of whether by choice or circumstance.
INSURANCE for TRAVEL and DIVING
For all scuba diving trips with Insider Divers it is customer obligation to have specific dive insurance. The costs for evacuation and treatment in hyperbaric chamber can be upward of 50.000 USD so its better to be covered. For trips to remote locations and all live-aboard trips it is mandatory to have dive insurance. such as DAN or DiveAssure. The latter is what we are using and can be booked here - I recommend basic Dive & Travel package for a year.

It is recommended to also have travel insurance to protect yourself against personal injury, loss, medical evacuation, medical assistance, hospitalization, damage, theft, cancellation, delay, weather related cancellations etc. The obligation lies with the customer to take out relevant and covering insurance.
INTERNATIONAL TRAVEL DOCUMENTS
It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc.
Travelers to international destinations will require a valid passport, and the passport must be valid for no less than 6 months after your arrival into the country. Passport and Visa requirements vary with each country and involve consideration of the length of stay in the country. It is your responsibility to fulfil the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.
HEALTH REQUIREMENTS
Please check with your physician for information on health requirements for the country to which you are traveling.
CHANGES AND CANCELLATION
Should you wish to make a change to your booking or cancel it, we will try our best to accommodate that. As mentioned above deposits and full payments are not refundable. But, if we find a replacement you will receive the full amount as travel credit with Insider Divers minus a cancellation charge of USD300.
We offer the replacement service for deposits and full payments. However, if you cancel and we can not find a replacement, we are liable to pay the operator the entire space, and your deposit or full payment will be used to cover these costs. Sometimes we have to offer discounts to sell your space, this will have to be deducted from the monies you have paid. If there are specific cancellation fees and charges incurred by our supplier this will also reduce your travel credit.
Because the cancellation costs are often only clear until the ship sails your travel credit usually only becomes valid after the trip has been completed. If you cancel your booking and we have secured a replacement of cancellation permission for you then a cancellation fee of USD300 per person will apply.
Generally your refund value will be converted into trip credit for future trips with Insider Divers or replacement trips by our suppliers.
If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer and we will support you with all necessary documentation.
In the situation of a travel warning for the destination country issued by the country of the client we will do our best to accommodate this in line with the suppliers terms and conditions.
Operator cancellations
Cancellations due to operator related problems cannot be covered by Insider Divers unless the operator provides refunds. Policies of our operators apply to our customers as well.
Neither the Operator or Insider Divers can be considered in breach of this contract to the extent that performance of their respective obligations is prevented by an Event of Force Majeure that arises before, during or after the travel dates. It is recommended for customers to sign travel insurance to prevent such cases.
ACCEPTANCE OF TERMS
By making a booking with Insider Divers Ltd., you acknowledge and agree that any disputes or legal matters arising from your booking or use of our services will be governed exclusively by the laws of the British Virgin Islands (BVI). No other legal jurisdiction will apply.
PRIVACY POLICY FOR CRM USE
As an extension of our services, Insider Divers Ltd. provides an invite-only Client Relationship Management (CRM) system for registered clients. The PORTAL is designed to facilitate trip planning while securely managing personal client data. The following terms govern the use of this closed PORTAL system:

The PORTAL is accessible strictly via invitation, limited to authorized clients and Insider Divers employees.
THIRD-PARTY SHARING

Personal data are only shared with our Suppliers (e.g., trip operators, guides, hotels, liveaboards) to facilitate bookings and fulfill your services.

While taking care to vet our Suppliers we cannot be held responsible for the Suppliers data handling.

Insider Divers Ltd. does not sell, rent, or otherwise disclose your personal data to unrelated third parties.
CLIENT RESPONSIBILITIES AND CONSENT

You are responsible for uploading accurate data to the PORTAL and notifying us of any discrepancies or updates.

By accessing and using the PORTAL, you agree to the collection, storage, and use of your personal information as outlined in these terms.
RETENTION OF DATA

Personal data will be retained only for as long as necessary to fulfill its purpose or as required by law. Personal data will be retained for the duration of your trip plus 12 months for record-keeping purposes unless otherwise required by law. Travel documents will automatically be deleted 60 days after your trip has been completed.

Following the conclusion of your trip, you can request to delete your PORTAL profile by contacting Insider Divers Ltd. at info@insiderdivers.com.
RIGHT TO ACCESS, MODIFY, OR DELETE DATA

As a customer, you have the right to view, request corrections to, or delete your personal information, provided legal or contractual obligations do not require otherwise.

You may access, update, or delete your data by accessing the PORTAL or contacting us at [info@insiderdivers.com] with proof of identity.
USE IN BVI JURISDICTION

In the event of a data-related concern or dispute, please contact us directly at {info@insiderdivers.com]. We will aim to resolve your concern within 30 days. If unresolved, disputes will be settled under BVI jurisdiction.

As a company registered in the British Virgin Islands, Insider Divers Ltd. complies with BVI law in maintaining the safety, privacy, and integrity of client data. Should disputes arise, they will be governed by the laws of the BVI.
