TERMS AND CONDITIONS

GENERAL

Insider Divers is offered by BVI registered Insider Divers Ltd. and we look forward to act as your booking agent for your travel needs. These terms and conditions (the "Agreement") describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer. The terms "we", "us" and "our" refer to Insider Divers. The term "you" refers to the customer, booking a reservation through us or otherwise using our services.

We sell a variety of diving trips from different suppliers and service providers ("Suppliers"). Each Supplier has its own terms and condition that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Our website, which is referred throughout this Agreement, can be found at www.insiderdivers.com.

Insider Divers is acting as intermediary or a "Booking Agent" for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services.

All airlines tickets are sometimes subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. You may be charged additional sums by Insider Divers to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. Acceptance of these terms and conditions hereby consent you to any post-purchase price increases and authorize Insider Divers to charge my credit card for such additional amounts.

LIABILITY

Insider Divers takes no responsibility for loss, damage or injury arising from any shortfall, error or omission in the information passed to the customer during the course of the sale or subsequent delivery of the product. The company takes no responsibility nor can be held liable for loss, damage, or injury that occurs on a supplier’s or service provider’s premises or transport, or between two such premises.

Professional LIABILITY

Participation in any of the Activities involves certain risks which may result in injury or death.  This warning does not purport to describe or disclose all risks associated with participation of the Activities.  There are a wide range of inherent risks when engaging in sports and particularly underwater sports; for example, with diving there is the risk of decompression sickness, embolism or other hyperbaric injury can occur that requires treatment in a recompression chamber.   Open water scuba diving trips may be conducted at sites that are remote, either by time or distance, from emergency services or recompression facilities.  Scuba diving, snorkelling and tours will involve uncontrolled encounters with wild animals which bears the risk of stings, bites, and at the extreme end, more serious injury and death.  Participants should be responsible and aware of animal behaviours and their own interactions and engage in these activities entirely at their own risk.

We will not be liable to you in respect of any personal injury (including without limitation serious injury or death) that you may suffer or sustain directly or indirectly as a result of attending the Trip or participation in the Activities.  Nor will we be liable to you in respect of any other losses arising as a result of any such personal injury (including without limitation loss of profit or earnings or other consequential losses).  We will not be liable to you in respect of any of your personal property that is lost, stolen or damaged before, during or after a Trip.

DEPOSIT AND PAYMENT

Deposits and full payments are generally non-refundable unless we find a replacement for your booking or the operator permits a cancellation due to their terms and conditions. 

The idea of a deposit is a commitment from your side towards the trip. We need to pay the operators (boats, hotels, dive shops) in advance, so we require some security that you plan to come. Unless you cancel very last minute we usually can find a replacement for you. In this case your monies will convert into travel credit with us minus bank transfer costs and a handling fee of USD100.

This is also the case for medically caused cancellations. We will provide you with documentation for your travel insurance. Please read the section below about cancellation procedures.

We will advise you of the date that full payment is required. Upon your provision of your payment information, you are authorising us to make the payment arrangements with the corresponding operator and their cancellation policies apply.

For flights a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier.

In rare cases after full payment the conditions of the contract with our Supplier may permit them to increase the cost of your arrangements - examples are increase in fuel costs, currency exchanges, marine park fees etc. We are required to pass on any such increase to you.

OPERATOR CANCELLATIONS

In the case that the local operator of your trip cancels without reason we will do our best to secure funds from the operator. In cases of cancellations due to travel restrictions, governmental regulation or force majeure we will negotiate with the operator in the clients name and aim to provide the best possible compensation. We cannot guarantee that all monies can be returned to the client, as we are dependent on what our local operator offers.

We are working closely with all our operators and aim to achieve 100% rebooking value on all cancelled/postponed trips. We are focussed on securing the best possible deal for our clients including securing replacement trips. However that is not guaranteed and depends on what the operator can provide.

ACCOMODATIONS

Based on shared occupancy. A single supplement is usually charged where one person necessitates single occupancy in accommodation, irrespective of whether by choice or circumstance.

 

INSURANCE for TRAVEL and DIVING

For all Insider Divers trips it is customer obligation to have specific dive insurance. The costs for evacuation and treatment in hyperbaric chamber can be upward of 50.000 USD so its better to be covered. For trips to remote locations and all live-aboard trips it is mandatory to have dive insurance. such as DAN or DiveAssure. The latter is what we are using and can be booked here - I recommend basic Dive & Travel package for a year.

It is recommended to also have travel insurance to protect yourself against personal injury, loss, medical evacuation, medical assistance, hospitalization, damage, theft, cancellation, delay etc. Both above mentioned insurers offer bundles with travel insurance.

INTERNATIONAL TRAVEL DOCUMENTS

It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc.

Travellers to international destinations will require a valid passport, and the passport must be valid for no less than 6 months after your arrival into the country. Passport and Visa requirements vary with each country and involve consideration of the length of stay in the country. It is your responsibility to fulfil the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.

HEALTH REQUIREMENTS

Please check with your physician for information on health requirements for the country to which you are traveling.

CHANGES AND CANCELLATION

Should you wish to make a change to your booking or cancel it, we will try our best to accommodate that. As mentioned above deposits and full payments are not refundable. But, if we find a replacement you will receive the full amount as travel credit with Insider Divers minus handling fee, banking fees and any cancellation charges. Cancellation fees and charges as well as administration costs incurred by our supplier are the responsibility of the traveller, so we have to pass these on to you. We will inform you of these costs before making any changes.

We offer the replacement service for deposits and full payments. However, if you cancel and we can not find a replacement, we are liable to pay the operator the entire space, and your deposit or full payment will be used to cover these costs. Sometimes we have to offer discounts to sell your space, this will have to be deducted from the monies you have paid.

Because the cancellation costs are often only clear until the ship sails your travel credit usually only becomes valid after the trip has been completed.

If you cancel your booking and we have secured a replacement of cancellation permission for you then a cancellation fee of USD100 per person will apply. We will inform you of the cancellation policy applicable on your invoice. 

Cancellation penalties may be different for each suppliers. If cancellation penalties differ from those outlined above, the client must pay the required penalties.

Generally your refund value will be converted into trip credit for future trips with Insider Divers or replacement trips by our suppliers.

If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer and we will support you with all necessary documentation. 

In the situation of a travel warning for the destination country issued by the country of the client we will do our best to accommodate this in line with the suppliers terms and conditions.

Operator cancellations

Cancellations due to operator related problems cannot be covered by Insider Divers unless the operator provides refunds. Policies of our operators apply to our customers as well. 

Neither the Operator or Insider Divers can be considered in breach of this contract to the extent that performance of their respective obligations is prevented by an Event of Force Majeure that arises before, during or after the travel dates. It is mandatory for customers to sign travel insurance to prevent such cases.

ACCEPTANCE OF TERMS

The placing of a booking with Insider Divers for services implies that you accept these booking conditions.
